It occurs to me that the rights to the railway would have been granted by an act of parliament, unless the act has been repealed and that would seem unlikely, would any less authority say TDC be able to stop them?
On a more serious note, the following is part of my original objection to the plans.

It would seem likely that the proposal to build up to a height of 3 meters above the cliff top is merely a ruse to detract attention from the fact that the building proposed is essentially a large concrete block of flats with plastic windows and a zinc roof its main leisure facility from its first conception being a bar. In most areas this type of building is being replaced with manageable buildings built with traditional construction methods architecturally in keeping with the buildings in the surrounding area

The answer is I don't know.
Ezekial claimed in a press release that the current planning application was still valid and he would be discussing change to the detail (presumably the height) with the developer.
Others take the view that since the planning application that was granted covered the detail then if the detail changes it will have to come back to committee for reapproval.
I assume the council solicitor will be advising the leader but as he also advises the Chair as to whether resolutions are 'in order' the resolution passed at council must itself have been valid.
In either event the work can't start without a development agreement being signed so as long as the council don't sign the agreement until they have agreed on the new design I hope the matter can be solved to both sides satisfaction. If the council signs the agreement in advance of the design agreement and rides rough shod over the view of full council then I can see this as a matter for the ombudsman at best or the courts at worst.
Sorry not to be able to shed much light.

I am trying to find out the situation with relation to the old Pleasurama site after the council decision not to sell the land to SFP for the development that would have extended above the cliff top.
Am I right in assuming that "a satisfactory development about, which meets the original concept accepted by Council on 5th December 2002" means that planning permission will have to be sought again.
Or has planning permission granted for the 5th December 2002 concept. If it has are the plans available for inspection.
